Terms of service

1. Who we are

This website, ehs-staybent.com, is operated by:

Hagen Techniek B.V., trading as EHS StayBent
De Trompet 2244, 1967 DD Heemskerk, The Netherlands
VAT NL861009812B01 · KVK (Dutch Chamber of Commerce) 77446356
info@ehs-staybent.com

"We", "us" and "our" mean Hagen Techniek B.V. "You" means the person or company placing an order.

2. Scope

These terms apply to every order placed through this website. By placing an order you accept them. Our privacy policy, shipping policy and refund policy form part of these terms.

If you buy through a dealer or distributor account, the agreement between us and your company takes precedence over these terms wherever the two differ.

3. Products and product information

We describe our products as accurately as we can, including their technical specifications. Photographs are illustrative; finishes, colours and hardware may vary slightly between production runs, and we improve our products continuously.

Skating equipment is technical equipment. Blades, boots, cups, bridges and mounting hardware must be selected, mounted, sharpened and maintained correctly to be safe. If you are not sure what fits your setup, ask us or an authorized dealer before ordering.

Availability shown on the website is indicative. If an item you have ordered turns out to be unavailable, we will tell you and refund it.

4. Prices and VAT

Prices are shown in euro.

  • Consumers in the European Union see prices including VAT at the rate of their own country. The rate applied is shown at checkout.
  • Customers outside the European Union see prices excluding VAT. Import VAT, customs duty and clearance charges are payable by the recipient on arrival — see the shipping policy.
  • Business accounts see net prices excluding VAT. VAT is applied at checkout according to the account's country and VAT status; intra-EU business customers with a valid VAT number are invoiced under the reverse-charge procedure.

We may change prices at any time. The price that applies to your order is the one shown when the order is confirmed. Obvious pricing errors do not bind us; if one occurs we will contact you and either confirm the correct price or cancel and refund the order.

5. Placing an order

Your order is an offer to buy. A contract comes into being when we send you an order confirmation. We may decline an order — for example where an item is unavailable, where we cannot ship to the destination, where a restriction described in section 6 applies, or where we suspect fraud.

6. Restrictions on ordering

Some orders cannot be accepted through this website:

  • United Kingdom: orders below €160 cannot be accepted, for the VAT-registration reason set out in the shipping policy.
  • Netherlands: long track boots, long track blades, long track jigs and all replacement and spare parts are supplied to consumers in the Netherlands through authorized dealers only.
  • Sanctioned destinations: we do not ship to Russia or Belarus or to any destination subject to EU or Dutch export restrictions.
  • Distributor markets: orders to countries served by one of our distributors may be routed to that distributor.

If an order reaches us that we cannot accept for one of these reasons, we will contact you and refund it.

7. Payment

We accept the payment methods shown at checkout. Payment is taken in full when the order is placed, unless your business account has agreed payment terms with us. Goods remain our property until they have been paid for in full.

8. Delivery

Orders are dispatched from our workshop in Heemskerk as soon as the goods are ready; made-to-order and custom items take longer, and we tell you when that applies to your order. Delivery times quoted by us or by the carrier are estimates. Risk passes to you when the goods are delivered to you or to someone you nominate. Details are in the shipping policy.

9. Cancellation, returns and conformity

Consumers in the European Union have a 14-day right of withdrawal, and a statutory right to goods that conform to the contract. Both are set out in the refund policy, together with the exceptions for made-to-order, heat-moulded, mounted and sharpened items. Nothing in these terms limits a consumer's statutory rights.

10. Use of the equipment

Speed skating carries an inherent risk of injury. Our products are designed and manufactured to be safe when correctly selected, fitted, maintained and used for their intended purpose, in the discipline they are made for.

You are responsible for:

  • having equipment mounted and set up correctly, by yourself or by a competent technician;
  • inspecting equipment before use, and withdrawing from use anything that is cracked, bent, corroded, worn or damaged;
  • observing the torque figures we publish for fasteners;
  • wearing appropriate protective equipment;
  • complying with the rules of your federation or rink.

We are not liable for injury or damage caused by incorrect fitting, modification, misuse, neglect, continued use of worn or damaged equipment, or use outside the intended discipline.

11. Intellectual property

All content on this website — text, photographs, drawings, video and the EHS StayBent and Technicords names and logos — belongs to us or to our licensors. You may not reproduce it commercially without our written permission. Dealers and distributors may use our product photography and text for the purpose of reselling our products.

12. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that may not be excluded under Dutch law — including a consumer's rights under product-liability and consumer-protection law.

Subject to that, our liability arising out of an order is limited to the value of that order, and we are not liable for indirect or consequential loss, including lost training or competition time.

13. Accounts

If you create an account you are responsible for keeping your login details secure and for everything done through your account. Business account holders must tell us promptly when a named user leaves the company. We may suspend or close an account that is misused.

14. Changes to these terms

We may update these terms. The version in force when you place an order is the version that applies to it.

15. Governing law and disputes

These terms are governed by the law of the Netherlands. Disputes are subject to the exclusive jurisdiction of the competent court in the Netherlands. A consumer resident in another EU country keeps the protection of the mandatory consumer law of their own country and may bring proceedings there.

Consumers may also use the European Commission's online dispute resolution platform.

16. Complaints

Email info@ehs-staybent.com with your order number. We aim to acknowledge complaints within two working days.
